The specially protected species in Wales are detailed in Schedule 1 of the Wildlife and Countryside Act, 1981 (as amended including by the Countryside Rights of Way Act 2000).

BTO can only process licence applications for the disturbance of specially protected species for purposes of ringing and nest recording. Limited photography at the nest during these activities is covered by such a permit. For other purposes see the Natural Resources Wales licensing web pages.
Schedule 1 Licence conditions: Be aware
The conditions on a Schedule 1 Licence form part of it. Failing to comply with these conditions means you are breaking the law and may be prosecuted. Be particularly aware that having landowner permission to access a nest is a condition of Welsh Schedule 1 Licenses. This means that if you have a Schedule 1 licence for both the species and the 10Km square but do not have landowner permission to approach specially protected breeding birds you are at risk of prosecution.
Most Welsh Schedule 1 licences also include liaison requirements as a condition, if these are not followed your licence may not be renewed.
